How many leave days is an employee entitled to per year?
In South Africa, the Basic Conditions of Employment Act (BCEA) provides for a minimum of 15 working days' annual leave per year for employees who work a 5-day workweek, or 18 working days' annual leave per year for employees who work a 6-day workweek.
This minimum entitlement applies to all employees, including full-time, part-time, and fixed-term employees.
It's important to note that an employment contract, bargaining council agreement, or collective agreement may provide for more generous leave provisions than those stipulated in the BCEA. In such cases, the more generous provisions will apply.
Employees are also entitled to additional leave days for family responsibility leave, sick leave, and maternity leave, which are provided for in the BCEA.
It's important for employees to check their employment contract or speak with their employer to ensure that they understand their full leave entitlements and any additional requirements or restrictions that may apply.
