Trade union Solidarity is of the view that the extension of the Covid-19 regulations is unlawful and irrational. They noted this due to the publishing of the regulations at 23:00.

Connie Mulder, Head of the Solidarity Research Institute says the government is trying to govern by ambush when publishing new regulations late at night that will come into effect in an hour.

He argued that the regulations, which allow the minister of health to decide on the mechanisms to stop the spread of the virus, could create space for abuse.

Mulder said, “We're going to have Covid-19 for realistically, I think the rest of our lives, we're going to have a degree of Covid-19 somewhere and that worries us immensely is a minister should not be able to plunge the country into lockdown level one when we've got empty hospitals by a couple of Covid-19 cases and that is what these regulations unfortunately also enable”.

Solidarity revealed that a legal letter was issued to the Minister of Health in which the minister is requested to disclose how the decision on the regulations was reached.

“We're going ahead with our legal action which says we think these regulations have been procedurally flawed and we're really worried but when we read through them we can see that these were hastily drafted and they weren't thought through,” said Mulder.
