One of the most difficult situations for companies to handle is an arbitration award that requires reinstatement or re-employment of previously dismissed employees. Apart from implications for the management of the rest of the workforce, the requirement not to be seen to victimise the employee/s is critical. Ivan Israelstam explains.

Days after hundreds of commuters were injured in a train accident in Soweto, authorities are introducing new laws which they say will improve rail safety. The South African Bureau of Standards (SABS) has published a national standard on human factors management, which it said was developed primarily to provide railway operators with the minimum requirements to manage human factors. The standard will be mandatory for all railway operators in South Africa.

Metrorail boss, Mosenngwa Mofi has confirmed that the train driver involved in last week?s train crash in Soweto has been fired. On 19 May 2011, a Metrorail train that was travelling from Mzimhlophe station, towards Phomolong station in Orlando, collided with a stationary Soweto Business Express train, injuring 857 people. No fatalities have been reported.

Eskom has confirmed the suspension of four of its employees after their appearance in a television interview last month.
