Debt counselling, as contemplated by the National Credit Act 34 of 2005, inter alia, provides the vehicle for over-indebted consumers to be relieved of their debt burden. Debt counsellors who are competent and registered by the NCR will perform the debt counselling process. Any individual who wishes to register as a debt counsellor must comply with all the requirements set out in the National Credit Act and Regulations.

Historically in South Africa, Muslim marriages have not been legally recognised. However, during post-apartheid South Africa, the judiciary recognised the Muslim marriage as a contract, and proven terms and customs emanating from that contract as legally enforceable.
