Government contracts and procurement law 2026

Government procurement accounts for a substantial part of the global economy and is therefore closely regulated in law to prevent fraud, waste, corruption or local protectionism.

This field of law called public procurement regulation is internationally one of the fastest growing areas of legal interest both in practice and academia. We will cover the important aspects of public procurement, and explain the relevant procurement law, analyse the new Procurement Act 28 of 2024 and discuss what has been achieved with regards to procurement policy, procedures and best practice.

Join us for a twenty-four-hour course, held over six days.

When and where?

The course is presented over six four-hour sessions.

We are pleased to present this course twice in 2026:

• 20 to 22 July and 27 to 29 July 2026 (Mondays to Wednesdays), 8:00 to 12:00 SAST
• 28 to 30 September and 5 to 7 October 2026 (Tuesdays to Thursdays), 13:00 to 17:00 SAST

This course will be held remotely, most likely on Zoom.

Course outline

The following topics will be dealt with during the course: 

• The government procurement process and its regulatory framework
• An overview of the Public Procurement Act 28 of 2024 which was signed into law on 23 July 2024
• The impact of the Constitution on government contracting processes
• Procurement methods and the use of competition
• Fairness and transparency in the negotiation and variation of contracts
• The fair treatment of participating bidders
• The right to reasons and access to information
• Procurement and black economic empowerment
• The availability of remedies to aggrieved parties

Presenter

Tanaka Mparutsa is a PhD Candidate in Commercial Law at the University of Cape Town. Her research interests are predominantly in the areas of contract law, public procurement law, company law, corporate governance and corporate compliance. Ms Mparutsa obtained the degrees LLB (University of Fort Hare), LLM in Commercial Law (University of Cape Town), LLM in International Commercial Law and Practice (University of Edinburgh in Scotland). Through her two LLMs she attained expertise in, inter alia, Advanced Contract Law in South Africa, Contract Law in Europe, Legal Aspects of Corporate Finance, Regional and International Corporate Governance, and Competition Law in Europe. She also practiced predominantly in the areas of government contracts, public procurement law and commercial law in general at Clark Laing Incorporated.
