Twin Peaks regulation and the Conduct of Financial Institutions Bill: An overview 2025

In the "twin peaks" model of financial services regulation, introduced by The FSR Act, the regulating authorities of the financial services sector are divided into two centres: the Prudential Authority and the Financial Sector Conduct Authority. Other legislation, such as the Insurance Act and the Conduct of Financial Institutions ("CoFI") bill, mean further developments in the industry.

This ten-hour course aims to demystify the relevant legislation that governs the twin peaks regulatory environment and aid participants in understanding the fundamentals.

The following topics will be covered:

  • How South Africa has implemented twin peaks model
  • The twin peaks models adopted by other jurisdictions
  • Introduction to Prudential Authority
  • Introduction to FSCA
  • Overview of the FSR Act
  • Overview of the new prudential regulation for the insurance industry
  • Review of the COFI Bill
  • Overview of new conduct standards

Presenter

Tanaka Mparutsa is a PhD Candidate in Commercial Law at the University of Cape Town. Her research interests are predominantly in the areas of contract law, public procurement law, company law, corporate governance and corporate compliance. Ms Mparutsa obtained the degrees LLB (University of Fort Hare), LLM in Commercial Law (University of Cape Town), LLM in International Commercial Law and Practice (University of Edinburgh in Scotland). Through her two LLMs she attained expertise in, inter alia, Advanced Contract Law in South Africa, Contract Law in Europe, Legal Aspects of Corporate Finance, Regional and International Corporate Governance, and Competition Law in Europe. She also practiced predominantly in the areas of government contracts, public procurement law and commercial law in general at Clark Laing Incorporated.
